Reporting Deadlines
- Serious injury, illness or death — report to Cal/OSHA immediately, and in no event more than 8 hours after the employer knows or should have known. Labor Code §6409.1(b).
- Citation appeal — 15 working days from receipt. Labor Code §6600.
- Non-attorney representation — permitted before the Appeals Board under 8 CCR §378(a).

Questions
Who is cited when a subcontractor’s employee is exposed?
Cal/OSHA applies the multi-employer worksite rule at 8 CCR §336.10 and may cite the controlling, creating, exposing or correcting employer, or more than one of them, for the same condition.
Does a project SWPPP require a certified preparer?
Yes. The Construction General Permit, Order WQ 2022-0057-DWQ, requires a Qualified SWPPP Developer to prepare and amend the SWPPP and a Qualified SWPPP Practitioner to implement it.
What triggers a site-specific IIPP rather than a company IIPP?
8 CCR §3203 requires the program to address the hazards actually present. On a construction site the hazards change by phase, so the program is written to the site and updated as conditions change.
