MSHA Standards That Apply
- 30 CFR Part 46 — training for shell dredging, sand, gravel, surface stone, surface clay, colloidal phosphate and surface limestone mines.
- 30 CFR Part 48 — training for underground mines and other surface mines.
- 30 CFR Part 56 — safety and health standards, surface metal and nonmetal mines.
- 30 CFR Part 57 — safety and health standards, underground metal and nonmetal mines.
- 30 CFR Part 47 — hazard communication.
- 30 CFR Part 62 — occupational noise exposure.
- 30 CFR Part 60 — respirable crystalline silica. PEL 50 µg/m³ as a full-shift 8-hour TWA; action level 25 µg/m³. Compliance date April 14, 2025 for coal mines and April 8, 2026 for metal and nonmetal mines.
Reporting Deadlines
- Accident notification — the operator shall contact MSHA within 15 minutes of knowing that an accident has occurred. 30 CFR §50.10.
- Accident, injury and illness report — MSHA Form 7000-1 within 10 working days. 30 CFR §50.20.
- Quarterly employment and production report — MSHA Form 7000-2. 30 CFR §50.30.

Questions
Which training part applies to a sand and gravel operation?
30 CFR Part 46. Part 48 applies to underground mines and to surface mines not listed in Part 46.
How fast must an accident be reported to MSHA?
Within 15 minutes of the time the operator knows or should know that an accident has occurred. 30 CFR §50.10. The MSHA hotline is 1-800-746-1553.
Does Cal/OSHA have jurisdiction over a mine site?
Working areas of a mine are under MSHA. Cal/OSHA may retain jurisdiction over operations on the property that are not mining, such as certain office, shop and construction activities.
